BREWSTER VILLAGE COUNCIL
January 3, 2017
7:00 P.M.
 
Brewster Village Council met in regular session with Mayor Mike Schwab presiding.
 
7:00 P.M. – CALL TO ORDER
 
Council Members bowed their heads for the invocation provided by Clerk-Treasurer
Kris King followed by the Pledge of Allegiance.

MINUTES FROM THE DECEMBER 19, 2016 REGULAR COUNCIL MEETING:
Mayor Mike Schwab asked if there were any additions or deletions to the December 19, 2016 Council meeting minutes. 
 
COUNCIL MEMBER THARP MOVED, SECONDED BY COUNCIL MEMBER FOX and motion carried to accept the minutes as presented.  The vote: All yes. 
 
PRESENTATION OF BILLS:
COUNCIL MEMBER GODWIN MOVED, SECONDED BY COUNCIL MEMBER THARP and motion carried to accept the bills in the amount of $ 127,341.66.  The vote: All yes. 
 
AUDIENCE:

ELECTION OF PRESIDENT PRO TEM OF COUNCIL:
Mayor Schwab opened nominations for position: Council Member Mackey nominated Council Member Hawk.  Council Member Hawk accepted the nomination.  There were no other nominations.
Mayor Schwab closed nominations.  Voice Vote: All yes.
 
REVIEW AND ADOPTION OF 2017 COUNCIL RULES:
COUNCIL MEMBER HILLIARD MOVED, SECONDED BY COUNCIL MEMBER HAWK and motion carried to put a five-minute limit on presentations by guests during Council meetings.  The vote: All yes.
 
Mayor Schwab suggested the addition of Rule 26A: Informal Resolutions as presented on December 19, 2016.  This rule defines and outlines the procedure for the passage of informal resolutions which do not require three separate readings.
 
COUNCIL MEMBER MACKEY MOVED, SECONDED BY COUNCIL MEMBER FOX and motion carried to add Rule 26A: Informal Resolutions to the Rules of Council.  The vote: All yes.
 
CONSIDERATION OF ORDINANCES:
RESOLUTION 01-2017:  A Resolution Amending Resolution 28-2013 to increase the transfer to the Sewer Debt Fund was given third reading.
 
COUNCIL MEMBER GODDWIN MOVED, SECONDED BY COUNCIL MEMBER THARP and motion carried to pass the resolution as presented.  The vote: All yes.
First Reading: A Resolution Authorizing the Renewal of a Sugarcreek Township Fire Contract.  Councilman Hilliard asked if Council would be setting up a meeting with the Trustees.  It is discussed later.
 
First Reading: An Ordinance Amending Ordinance 18-2015 to Modify General Funds Transfers.
 
First Reading: An Ordinance Authorizing the Adoption of an Employee 5.01 Holiday Policy for Employee Handbook.
 
First Reading: An Ordinance Authorizing the Adoption of an Employee 5.02 Vacation Policy for Employee Handbook
 
FOR SIGNATURES: Approved on 12/19/2016 - a Resolution of Appreciation for Hunter Wells – Declaring January 7, 2017 as Hunter Wells Day in the Village of Brewster.
 
MUNICIPAL DEPARTMENTS:
Fire Department: Chief Chris Colucy
The department is looking into two grants.  One is for the Fire Inspector training that occurred in 2016 and the other is for Fire Equipment.
 
There were 622 calls in 2016.
 
Dependency Board Appointments – Two members of Council; required to meet by 01/31/2017.
 
Power Cots to be installed at $ 1500 each; Council invited to a Cot demo after Council Meeting. Councilman Hilliard asked who was installing the cots.  Chief Colucy stated the gentleman that installed the power cots for Massillon will be doing the installation.  Chief Colucy stated the gentleman was bonded and insured.
 
Police Department:Chief Keith Creter
Introduction of Part Time Police Officer Candidate Jeffery Martin; Chief and Mayor recommend that he be appointed pending a physical/drug test.
 
Lexipol review and edit is complete and is in place.  It went into effect on December 30, 2016.
 
2016 PD Activity Report (Email from Chief).  There were 498 calls in December and 5,271 for the year.
 
Councilman Hilliard asked where the department was with the part time officers. Chief Creter stated the department was possibly losing an officer to the County and the new candidate would replace the one leaving.
 
VILLAGE SOLICITOR:Attorney John Anthony
Last meeting, Council instructed Solicitor Anthony to compose a letter that the Village is taking an official position with the Walkers that they can hook up to our sewer system but that all costs will be assumed by the Walker’s and that no moneys, loans, or assessments will be on the Village’s dime.  Solicitor Anthony received a response requesting for clarification.
 
Solicitor Anthony prepared a draft for the proposed Medical Marijuana Ban legislation for the Village Planning Commission review on January 19, 2017.
 
Solicitor Anthony was concerned with the recently passed Purchase Power Agreement.  It is a 30-year agreement without a termination clause.  He contacted AMP to discuss his concern with their attorney and came away with an understanding of their approach.
 
Several Local Government Law Conference topics were discussed:  Solicitor Anthony learned that some local zoning for signage may be unconstitutional and he will be reviewing our zoning language.  They discussed Home Rule and how the State has slowly been eroding the local municipalities authority.  Some examples are residency requirements, gun rules, local income tax, and traffic cameras.  Solicitor Anthony stated the trend seems to be the continuing of these erosions of official local authority.

Thanks to all households and judges that participated.
 
Councilman Hilliard stated the Historical Society is holding a quarter auction at the Wandle House on January 21st.  He asked that the community come out and support this event.
 
VILLAGE ADMINISTRATOR: Mike Miller
Administrator’s report for period 12/20/2016 thru 1/3/2017:
  • We had an emergency call out early Christmas morning for a water leak.
 
  • I submitted the Village’s 2017 Municipal Road Fund (MRF) Application for Elton Street from SR 93 to Browndale.
 
  • We have revised Statements of Qualifications from eight (8) engineering firms in response to our request. We advertised for Statements of Qualifications for any/all potential projects that would require engineering services for 2017. We plan to begin reviewing and ranking the firms that responded based on their qualifications for specific projects as we move forward next year. An outline of our process has been sent out to Council.
 
  • I have been working on a number of policies as a result of discussions with our Law Director and outside Council. While some can be adopted administratively, some will be forwarded to Council for adoption.
 
Council Member Hilliard stated there are leaves all over the roads.  In front of his house they are clogging the storm sewer grate and causing water from his sump pump to freeze on the road.  VA Miller stated he would have the Street Department clear the grates off as weather permits.
 
VILLAGE MAYOR: Mike Schwab
1.            First Meeting in January is the Organizational Meeting of Council
2017 Assignment of Council Committee Chairmen – 2016 Council Rules provides that the Mayor assigns a Chairman to each Committee; current assignments will bereappointed for 2017 unless a reassignment is desired:
  • Public Safety: Tom Hilliard
  • Finance, Purchasing, and Appropriations: Chuck Hawk
  • Personnel, Rules of Council, and Insurance: Steve Tharp
  • Buildings, Parks, and Grounds: Dave Godwin
  • Streets, alleys, Curbs, Storm Sewers, and Sidewalks: Paul Mackey
  • Public Utilities: Dale Fox
Council Member Tharp stated he no longer wanted the insurance.  Council Member Hawk stated he would trade committees with him.  Mayor Schwab stated he would make a new list to reflect the change.
 
2.            Security Cameras
  • VA has arranged with the contractor that when the weather cooperates the Council approved security camera systems will be installed at: North Water Tower on Chestnut, South Water Towers off of E. Seventh, Seventh Street Electric Substation, Water Plant and Water Wells & Electric Department Buildings on W. Fourth, & Wastewater Plant off of S. Wabash
  • When finances become available Council may want to explore additional cameras at various Village sites as the systems installed at the Yard Waste Drop-off (a deterrent) and at the Gazebo (identified a vandal and trespassers) have served the purposes intended.
 
Councilman Hilliard would like to see cameras at the skate park.  Councilman Godwin stated he has been trying to get them for two years.
 
3.            VA Miller has advised that a Village Community Reinvestment Council needs to be appointed.
O.R.C. Section 3735.69 requires that a local seven member CRA Council make an annual inspection of the properties within the community reinvestment area for which a tax exemption has been granted.  The seven members:
  • Two members appointed by Council
  • Two members appointed by Mayor
  • One member appointed by Village Planning Commission
  • Two members appointed by the five above appointed members
 
Mayor respectfully appoints James Spivey of 185 E. Fourth Street and himself to the Village CRA Council.  All members will be on three years terms effective 1/1/17.
 
4.            Sugarcreek Twp. Fire Contract Renewal - Legislation Drafted for a Two Year Contract
                Does Council desire to meet with SC Township Trustees to discuss contract?
 
5.            Some Housekeeping - Local Board of Municipal Income Tax Review           
  • Three members are required under State and Village guidelines, two appointed by Council and one by the Mayor; all to a two-year term; Council appointees may not be an employee, elected official, or an employed contractor.
  • Mayor appointed Judy Maybaugh on April 4, 2016 to the Village Board of Income Tax Review
  • This Board reviews any appeals of assessments made by Village Income Tax Commissioner
(disputes can be concerning underpayment, reduction in refund, and similar issues)
 
6.            Refrigerator Magnet Update – Current sample: Council Review and Suggestions.  Councilman Godwin suggested adding the school numbers to the magnet and Councilman Hilliard suggested making them bigger so they are easier to read.           
 
7.            Mayor’s State of the Village will be at the January 16th Council Meeting after review of the Village Clerk-Treasurer’s 2016 Financial Reports                          
 
VILLAGE CLERK-TREASURER:Kris King
December and 2016 Financial statement were provided to Council.
 
The Local Government Officials Conference will be held on April 12th and 13th in downtown Columbus.
 
COMMITTEES or COUNCIL REPORTS: The Goal of any committee meeting is to discuss an issue or proposal and to provide, by a consensus of the committee members, ONE recommendation to Council
Economic Development Committee met this evening. 
 
AMP AMI (Advanced Metering Infrastructure) Program WebEx presentation at Village Hall on Wednesday, January 4 at 9:30 am.

PENDING PROPOSALS FROM PAST MEETINGS:
From Employee Healthcare Agent Brian Savage – Benistar Option in Employee Healthcare Plan
Mayor suggests that this option be made available to any Village employee eligible for Medicare; this
option will get such an employee off of the Village employee healthcare plan & provide such an     employee with a supplement to his Medicare coverage.
 
OLD or NEW BUSINESS: (Council Rules dictate a one meeting review period for expenditures, unless deemed an emergency)
COUNCIL MEMBER HILLIARD MOVED, SECONDED BY COUNCIL MEMBER FOX and motion carried to appoint Jeffrey Martin as a probationary part time Police Patrolman pending successful physical, drug screen, and background check.  The vote: All yes.
 
COUNCIL MEMBER THARP MOVED, SECONDED BY COUNCIL MEMBER MACKEY and motion carried to appoint Councilman Fox to the Fire Dependency Board as Chairman and Councilman Godwin as Secretary.  The vote: All yes.
 
COUNCIL MEMBER HILLIARD MOVED, SECONDED BY COUNCIL MEMBER HAWK and motion carried to set up a meeting with Sugarcreek Township Trustees and try for January 23rd at 6:30 pm.  The vote: All yes.
 
Councilman Hilliard asked for information on the Planning Commission meeting scheduled on January 19th.  VA Miller reviewed the three proposed topics as advertised.
