BREWSTER VILLAGE COUNCIL

JANUARY 16, 2012

7:00 P.M.

 

Brewster Village Council met in regular session with Mayor Mike Schwab presiding.

 

7:00 P.M. – CALL TO ORDER

 

Council members bowed their heads for the invocation provided by Clerk-Treasurer K. Kris King followed by the Pledge of Allegiance.

MINUTES FROM THE JANUARY 3, 2012 REGULAR COUNCIL MEETING:

Mayor Mike Schwab asked if there were any additions or deletions to the January 3, 2012 Council meeting minutes.  There were none.

 

COUNCIL MEMBER BICHSEL MOVED, SECONDED BY COUNCIL MEMBER HUFF and motion carried to accept the minutes.  The vote: All yes.

 

PRESENTATION OF BILLS:

COUNCIL MEMBER THARP MOVED, SECONDED BY COUNCIL MEMBER BICHSEL and motion carried to accept the bills for the amount of $ 345,066.86.  The vote: All yes.

 

AUDIENCE TIME:

The following residents were present: Ray Heitger, LaVonne Heitger, Linda Taylor, Paul Mackey, Cindy Mackey, Donna Smith, Norma Duff, Nick Pumneo, Nancy Fowler, Dale Fox, Kathy Loretto, Kris Wilson, and Ken Reed.

 

CONSIDERATION OF ORDINANCES:

ORDINANCE #03-2012: An ordinance authorizing a contract change order to Central Allied for the 2011 Street Paving Project was given third reading.  The change order is for $ 26,142.97.  Council Member Hilliard stated he spoke to the Village Administrator and now understood the cost increases but questioned why they weren't brought before Council.  Mayor Schwab stated it has always been the Village Administrator's call.

 

COUNCIL MEMBER BICHSEL MOVED, SECONDED BY COUNCIL MEMBER GODWIN and motion carried to pass the ordinance as read.  The vote: All yes.

 

RESOLUTION #04-2012: A resolution authorizing the Mayor and Clerk-Treasurer to enter into agreement with Financial Network of America for the Administration of an Employee Deferred Compensation Plan was given third reading.  The Mayor had the Clerk explain the plan.  Council Member Huff suggested using a no-load plan.

 

COUNCIL MEMBER DUFF MOVED, SECONDED BY COUNCIL MEMBER THARP and motion carried to pass the resolution as read.  The vote: All yes.

 

RESOLUTION #05-2012: A resolution authorizing to apply for, accept, and enter into a water pollution Control Loan Agreement on behalf of the Village of Brewster for planning, design, and/or construction of wastewater facilities, and designating the dedicated repayment source for the loan was given third reading.  Council Member Tharp was concerned that they had not pursued grants as he suggested.

 

COUNCIL MEMBER DUFF MOVED, SECONDED BY COUNCIL MEMBER GODWIN and motion carried to pass the resolution as read.  The vote: All yes.

 

An Ordinance approving, adopting, and enacting American Legal Publishing's Ohio Basic Code, 2012 Edition as the Village's Code of Ordinances was given first reading.

 

COUNCIL MEMBER THARP MOVED, SECONDED BY COUNCIL MEMBER DUFF and motion carried to introduce an ordinance for the 2012 Permanent Appropriations.  The vote: All yes.

 

An Ordinance establishing permanent appropriations was given first reading.

 

Council Member Hilliard asked Solicitor McCallin about the ordinances that Prosecutor Chapanar wanted introduced concerning the break-ins.  Mayor Schwab gave his copies to Councilman Hilliard.

 

MUNICIPAL DEPARTMENTS:

Fire Department:

Chief Patterson requested to send two firemen to the Howell Rescue Extrication Class at a cost of $525 per person class fee and $89 for lodging.  The total cost would be $ 1,139.00.

 

Chief requested to encumber $295.00 for the purchase of a new pair of boots.  One of the firemen's boots need replaced.

 

Chief discussed the disaster plan meeting with the Railroad and the Dairy.  Hoping to include the school and nursing home in the next meeting on February 27.  Discussed pamphlets being made and distributed.

 

Police Department:

Sergeant Denise Rossiter and Council Member Hilliard are working together to start up the Neighborhood Watch Program.

 

The new heating/cooling system has been installed and is working.

 

Review of State Liquor Permits in Brewster: no objections.

 

Newly appointed PT Patrolman Mike Spivey is ready to be placed on the schedule when needed.

 

Mayor's request of PD:           a. Contact Massillon Independent for break-ins and so forth

                                                b. Wash vehicles once a week when practical

 

Patrolman Nathan Taylor presented a grant for $22,000 worth of equipment from Homeland Security.  It is a license plate reader and a laptop for the cruiser.  He explained the grant and that there is a $1,600 maintenance fee at three years and $800 a year after that.  He has been appointed as a Terrorism Liaison Officer through Homeland Security. 

 

Fire Chief Patterson discussed NIMS certification of elected officials.

 

SOLICITOR:

Mayor Schwab has requested that Solicitor McCallin educate Council on different topics of their legislative responsibilities.   The evening topic of "Village Government 101" was the Mayor's authority and responsibilities.

 

COMMUNICATIONS:

StarkCountyRegional Planning Commission: Review Council appointments: 2011 Council members Tom Hilliard and Steven Tharp.

 

OhioDept of Liquor Control: Hearing for a D1 liquor license at the Dolley Madison House at 360WabashN.  D1 is beer only for on premises consumption or in sealed containers for carry out.

 

Donation request from Brewster Friends' Church Community Chorus; Mayor wishes to refer to Finance Committee.

 

VILLAGE ADMINISTRATOR:

Absent due to illness.

 

OhioEPA Letter: Annual Sludge Report from Wastewater Utility is required by January 31.

 

House Maintenance Code reminder mailed to owners at525 Wabash   Avenue N.  Council Member Hilliard heard from several individuals that the house is being repossessed.  There was a discussion as to whether the dogs were still in the house and if anyone was living there.

 

The Village Administrator, Supt. Maybaugh, several council members, and the Mayor met with Scott Ankrom of Hazen and Sawyer to review the proposed Wastewater Pump Station Project.

 

Council Member Huff asked about the bill for Zeigler Construction.  The Clerk stated the check had been released.  Council Member Huff stated that it should not have been released until it was brought before Council.

 

MAYOR’S REPORT:

Council needs to sign the Resolution of Appreciation for George Patterson and Dale Fox.  Mayor is looking into putting it on metal.

 

The Mayor would like each Council Member to develop a project to propose in the coming months.

 

Committee assignments were distributed.  Council was asked to review for approval at 01/16/12 meeting. 

 

Mayor's monthly statement to Council = $0.00.

 

Council Rules should have been reviewed. Are there any changes desired?

 

2012 Utility Data: Usage numbers and revenues and expenses.

 

Mayor Schwab presented Council with the Village finances.  He showed the annual numbers and how the balances fluctuated over several years.  He discussed the Capital Project Fund and earmarking it for a project.  Council Member Huff brought up the Sewer Project.  The Street Improvement Fund and street inventory were also discussed.

 

Five Year/Ten Year Plans: In coming months a review and assessment of all components of Village infrastructure in all departments with an eye toward an efficient overall operation: the Village Administrator has begun the review; Supt's to be involved.

 

Planning Commission appointments for six year terms: Joe Musacchia, Chuck Hawk, and Tim Gardner.

 

Zoning Board of Appeals appointments for three year terms: Don Glick and Jerry Layne.

 

Working with Bob Luckring of the Historical Society to display Brewster photos in Village Hall.

 

Council Member Tharp wanted to discuss removing the Village Administrator as chairman of the Economic Development Committee.  He has information he is going to give to the Mayor.

 

COUNCIL MEMBER HILLIARD MOVED, SECONDED BY COUNCIL MEMBER BICHSEL  and motion carried to put Tim Stith on the Tree Commission.  The vote: All yes.

 

Council Member Duff would like removed from the Finance Committee.  Council Member Hilliard stated he would take his position.

 

COUNCIL MEMBER BICHSEL MOVED, SECONDED BY COUNCIL MEMBER THARP and motion carried to replace Council Member Duff with Council Member Hilliard on the Finance Committee.  The vote: All yes.

 

COUNCIL MEMBER THARP MOVED, SECONDED BY COUNCIL MEMBER BICHSEL and motion carried to approve the Council Committees as amended.  The vote: All yes.

 

VILLAGE CLERK-TREASURER’S REPORT:

Mayor Schwab has requested that Clerk-Treasurer King educate Council on different topics of Village finances.   The evening's topic of "Village Finance 101" was the General Fund. 

 

Letter from Governor Kasich confirming receipt of Resolution 34-2011 - Village's opposition to State handling collection of municipal income tax; also received a call from Senator Oelslager stating he understands our concerns.

 

Presented Council with copies of the Certificate of Total Amounts Available for 2012.

 

Presented Council with the most current Sunshine Law manuals and a schedule of classes for 2012.

 

COMMITTEE OR COUNCIL REPORTS:

Council Member Hilliard reported on the Safety Committee meeting for the Neighborhood Watch Program.  In six to eight weeks he plans to have open meeting for all six sections of town and find a leader for each section.  Sergeant Rossiter wants everyone to be aware of their surroundings and get to know their neighbors.

 

Council Member Bichsel reported on the Finance Committee meeting discussing the Street Improvement Levy.  Putting it back on the ballot in November was discussed.  She wants to find out what exactly the residents are unhappy with the Village's spending.  She would like to have a Finance Committee meeting every month.

 

 

EXPENDITURE REQUESTS FROM PAST MEETINGS:

None.

 

OLD/NEW BUSINESS:

COUNCIL MEMBER BICHSEL MOVED, SECONDED BY COUNCIL MEMBER THARP and motion carried to have a Finance Committee meeting on February 6th at 6pm to discuss upcoming donations and on February 20th at 6pm to discuss the Capital Projects Fund.  The vote: All yes.

 

COUNCIL MEMBER THARP MOVED, SECONDED BY COUNCIL MEMBER BICHSEL and motion carried to appoint Joe Musacchia, Chuck Hawk, and Tim Gardner to the Planning Commission for six year terms and Don Glick and Jerry Layne to the Zoning Board of Appeals for three year terms.  The vote: All yes.

 

Council Member Duff nominated Council Members Hilliard and Tharp to the Tax Incentive Board.  No vote was required.

 

COUNCIL MEMBER HUFF MOVED, SECONDED BY COUNCIL MEMBER BICHSEL and motion carried to have a Insurance Committee meeting on February 6th at 6:30pm and on February 20th at 6:30pm to discuss the Health Insurance renewals.  The vote: All yes.

 

Council Member Tharp wanted to know if the Fire Department needed the approval for the Howell Rescue Extrication Classes to be passed under emergency.  Chief Patterson said no.

 

COUNCIL MEMBER GODWIN MOVED, SECONDED BY COUNCIL MEMBER HUFF and motion carried to change the lights downtown to be red onWabashfor only twenty seconds.  The vote: All yes.

 

COUNCIL MEMBER BICHSEL MOVED, SECONDED BY COUNCIL MEMBER GODWIN and motion carried to have a consensus of Council to approve the acceptance of the LPR Tool grant as presented by Officer Taylor.  The vote: All yes.

 

COUNCIL MEMBER THARP MOVED, SECONDED BY COUNCIL MEMBER BICHSEL to accept the current Council Rules for 2012.   Council Member Hilliard asked the Clerk if there is enough time allotted for her to get the bills done.  She stated it was fine.  The vote: All yes.

 

COUNCIL MEMBER THARP MOVED, SECONDED BY COUNCIL MEMBER BICHSEL and motion carried to adjourn the meeting at 8:29pm.   The vote: All yes.
