BREWSTER VILLAGE COUNCIL OF THE WHOLE COMMITTEE WORK SESSION

JULY 27, 2015

Village Officials Present:

Meeting called to order by Council Member Mackey

This meeting was called to discuss issues concerning the opening of streets and alleys in the Village. Specifically the alley designated Lake Erie Place.

There were arguments among the Members of Council concerning the Status of platted streets and alleys in the Village.

There are differences among the Members of Council concerning the interpretation of Ordinances addressing streets and alleys in the Village.

Solicitor Anthony is doing legal research on the issue following a discussion that took place during the July 20, 2015 regular Brewster Village Council Meeting. Mr. Anthony will present Council with an opinion as soon as his research is completed.

In the mean time, since the Committee cannot legally determine if this alley was ever officially opened by Ordinance, and since citizens of the Village have been using this alley way for several years with apparent acknowledgment by the Village, this Committee will propose to Council that Lake Erie Place alley be repaired and brought up to Village alley construction specifications at the expense of the Village of Brewster.
