Roll Call: Dale Fox, Dave Godwin(absent), Chuck Hawk, Andrew Hess, Tom Hilliard, and Sydney Radich

Also in attendance: Mayor Mike Schwab, Village Administrator Mike Miller, and Clerk-Treasurer Kris King

 

Tonight’s Public Hearing was advertised in the Massillon Independent on November 27, 2018

 

Business:     Four additions/modifications to the Village Zoning Code recommended by the Planning Commission on September 20, 2018

 

  1. Council’s review of the Village Planning Commission’s recommendation to modify Village Zoning Code Chapter 153.120 – R-5 Mobile Home Park Residential District

 

  • The currentVillage Zoning Code Chapter 153.120 was adopted in 1974 (Council copy)
  • The proposed modification language was provided to Council on October 1, 2018
  • The ordinance adopting the Planning Commission’s recommended modifications had a Third Reading on November 19, 2018.  A copy was provided to Council by email on January 1st and a hard copy is provided this evening

 

  • The modifications recommended provide:

1. A specific residential district for mobile and manufactured homes

2. Update in language to better reflect the Ohio Revised Code

3. Updated Application and Development Standards

 

  • Council Discussion: Councilman Hilliard asked if this modification requires 10 acres.  Councilman Hawk stated this modification would require the Planning Commission to review case by case anything that was smaller than 10 acres.  Mayor Schwab commented that the intent of this legislation was to update forty-year-old legislation.

  1. Council’s review of the Village Planning Commission’s recommendation to modify Village Zoning Code Chapter 153.250 – Modular Homes, Manufactured Homes. & Mobile Homes

 

  • The currentVillage Zoning Code Chapter 153.250 was adopted in 1974 and modified in 2000

(Council copy)

  • The proposed modification language was provided to Council on October 1, 2018
  • The ordinance adopting the Planning Commission’s recommended modifications had a Third Reading on November 19, 2018.  A copy was provided to Council by email on January 1st and a hard copy is provided this evening

 

  • The modifications recommended provide:

1. Update in language to better reflect the O.R.C. and the Ohio Department of Commerce

2. Updated Application and Development Standards

 

  • Council Discussion: Restricts double-wides, manufactured homes, and mobile homes to an R-5.
  • Audience Comment: “Anyone in the Audience that wishes to comment on the above language modification to the Village Zoning Code should be recognized by the Chair, Stand, and provide their name, address of their place of residence, and provide their comment”: No comments.

 

  1. Council’s review of the Village Planning Commission’s recommendation to modify Village Zoning Code Chapter 153.019O – Accessory Buildings w/additional language for Carports

 

  • The current Village Zoning Code Chapter 153.019O concerning Accessory Buildings was adopted in 1974 (Council copy)
  • The proposed modification language was provided to Council on October 1, 2018
  • The ordinance adopting the Planning Commission’s recommended modifications had a Third Reading on November 19, 2018.  A copy was provided to Council by email on January 1st and a hard copy is provided this evening

 

  • The modifications recommended provide:

1. An expansion of “Accessory Buildings” language in Village Zoning Code by adding standards for the installation and construction of Carports

 

  • Council Discussion: Councilman Hilliard stated there are 225 or more renters in the Village and some of them can only afford carports.  VA Miller stated not to gripe when you see something you don’t like the looks of.  Councilman Hawk stated the Planning Commission spent a lot of time trying to figure ways to tweak it to be bullet proof.  Councilman Hilliard is not in favor of it until it is more tweaked.

  1. Council’s review of the Village Planning Commission’s recommendation to modify Village Zoning Code Chapter 153.002 – Definitions w/additional language for “Foundations”

 

  • The current Village Zoning Code Chapter 153.002 was adopted in 1974 and does not provide a specific definition for Foundations
  • The proposed modification language was provided to Council on October 1, 2018
  • The ordinance adopting the Planning Commission’s recommended modifications had a Third Reading on November 19, 2018.  A copy was provided to Council by email on January 1st and a hard copy is provided this evening

 

  • The modification recommended provides:

                1. An addition to the Village Zoning Code – Definitions would clarify the expected standard for

                   foundations that is now lacking. The current language in the Village Zoning Code mentions

                  “foundation” a number of times, but only states a dwelling or structure should be attached

                   to a foundation and does not set a standard for the foundation

                2. The proposed addition to the Village Zoning Code:

                “Foundation” is the part of a structural system that supports and anchors the superstructure

               of a building and transmits its loads directly to the earth. To prevent damage from repeated freeze-thaw cycles, the bottom of the foundation must be below the frost line.  A foundation   shall be constructed in accordance with the Ohio Building Code.              

 

  • Council Discussion: Councilman Hilliard stated the frost line is 40 inches.
