Call Public Hearing to Order: Mayor Schwab

Tonight’s Public Hearing was advertised in the Massillon Independent on October 16, 2019

 

A. Business:        That Parcel #10010433 be designated as an Agricultural Zoning District

 

  • Parcel #10010433 that was approved by the Stark County Commissioner for annexation into the Village of Brewster on June 26, 2019.  This property is owned by the Village of Brewster and is the site of a Solar Field contracted to NextEra by the Village for the Brewster Electric Utility.
  • On August 5, 2019 Brewster Village Council asked the Village Planning Commission to recommend a zoning district designation for Parcel #10010433.  The Planning Commission met on September 19, 2019 to review and consider this request from Village Council
  • Council was provided with a copy of the Planning Commission’s September 19, 2019 hearing on September 23, 2019.  The PC’s actions concerning this recommendation were outlined in those Minutes. The Planning Commission’s September 19, 2019 hearing was advertised and conducted in accordance with the Ohio Revised Code and Village ordinances
  • At their September 19, 2019 hearing the Planning Commission’s recommended that the recently annexed Parcel #10010433 be designated as an Agricultural Zoning District (A-1)
  • On September 23, 2019 as required by the Ohio Revised Code and Village ordinances Council directed that legislation approving the Planning Commission’s recommendation be created and that tonight’s Public Hearing be scheduled and advertised.
  • The legislation adopting the Planning Commission’s recommended designation of Parcel #10010433 as an Agricultural Zoning District will have a Third Reading tonight.  A copy was provided to Council by email on November 12, 2019 and a hard copy is provided this evening

                b. Surveyor’s Annexation Plat drawing which is on file with County Recorder

                c. Village Zoning Code Chapter 153.250:  A-1 Agricultural Zoning District newly adopted                                  by Village Council and emailed to Council on November 14, 2019

 

B.            Council Discussion: Councilman Hilliard asked who owned the property to the north.  VA Miller stated it is a flood plain owned by the Army Corp of Engineers.  No one can build on it.
