BREWSTER VILLAGE COUNCIL
October 21, 2013
7:00 P.M.
Brewster Village Council met in regular session with Mayor Mike Schwab presiding.
7:00 P.M. – CALL TO ORDER
Council Members bowed their heads for the invocation provided by Clerk-Treasurer Kris King followed by the Pledge of Allegiance.

COUNCIL MEMBER HILLIARD MOVED, SECONDED BY COUNCIL MEMBER GODWIN and motion carried to excuse Council Member Huff from tonight's meeting. The vote: All yes.
MINUTES FROM THE OCTOBER 7, 2013 REGULAR COUNCIL MEETING:
Mayor Mike Schwab asked if there were any additions or deletions to the October 7, 2013 Council meeting minutes. Council Member Strausbaugh requested that his comments on the Muskingum issue be put in the minutes.
COUNCIL MEMBER BICHSEL MOVED, SECONDED BY COUNCIL MEMBER THARP and motion carried to accept the minutes with additions. The vote: All yes.
PRESENTATION OF BILLS:
COUNCIL MEMBER GODWIN MOVED, SECONDED BY COUNCIL MEMBER BICHSEL and motion carried to accept the bills for the amount of $ 362,835.02. Council Member Hilliard stated the Monster ad for the lineman was too expensive at $ 385.00. He also questioned whether the Davey bill of $ 2,493.10 was a duplicate from the last meeting. Clerk-Treasurer King stated this bill was for an additional week. Council Member Hilliard also restated that he feels the oil changes should be done locally. The vote: All yes.
AUDIENCE:
The following residents were present: Ray and LaVonne Heitger, Dale Fox, Paul and Cindy Mackey, Nick Pumneo, Dave Jones, and Ronnie Kaser.
CONSIDERATION OF ORDINANCES:
RESOLUTION 42-2013: A Resolution Accepting the Amounts & Rates as Determined by the County Budget Commission was given third reading.
COUNCIL MEMBER GODWIN MOVED, SECONDED BY COUNCIL MEMBER THARP and motion carried to approve Resolution 42-2013 as read. Clerk King explained the resolution. The vote: All yes.
Tabled on 09/16/2013 at Second Reading – Adjusting the compensation of Council Members and the Meeting Allowance for Clerk-Treasurer. Council Member Hilliard stated he wanted to keep this tabled.
MUNICIPAL DEPARTMENTS:

Wastewater Department: Supt Mike Maybaugh
Update: the quote for Council’s consideration for a 2014 Ford F-250 from Downtown Ford at $24,988.37 (cab & chassis, only) which meets State Coop Purchasing cost; $ 1000 to remount snow plow assembly; cost for installing current utility bed = $ 600 includes undercoating; Downtown will give $ 6000 for trade-in of the 2003. Mayor provided Council copies of Downtown’s Trade-in appraisal sheet, Kelly Blue Book print out, and Solicitor trade-in advisory.

COUNCIL MEMBER THARP MOVED, SECONDED BY COUNCIL MEMBER BICHSEL and motion carried to go into executive session to conference with our attorney about pending court action at 7:15pm. The vote: All yes. All Council, Mayor, and Solicitor exited the room.
COUNCIL MEMBER THARP MOVED, SECONDED BY COUNCIL MEMBER BICHSEL and motion carried to exit executive session at 7:56pm. The vote: All yes.
COUNCIL MEMBER HILLIARD MOVED, SECONDED BY COUNCIL MEMBER THARP and motion carried to go into executive session to discuss purchase of property at 7:56pm. The vote: All yes. All Council, Mayor, Clerk, and Solicitor exited the room.
COUNCIL MEMBER HILLIARD MOVED, SECONDED BY COUNCIL MEMBER BICHSEL and motion carried exit executive session at 8:09pm. The vote: All yes.
COMMUNICATIONS:
Resident Nick Pumneo, Jr. – Requests that the utility easement between Lots 1493, 1494, & 1495 be vacated. This will allow these parcels to be combined into one buildable lot. Mayor provided council with a copy of the request and a map of the area. VA advises that the easement is no longer needed. It will take a resolution.
Village Prosecutor Larry Chapanar has submitted a Contract renewal at $ 11,500. Mayor Schwab provided council with a sheet listing Attorney Chapanar’s Salary since 2002; Mayor Schwab recommends the increase. It will take an ordinance.
Donation Application: Fairless Food Cupboard - $ 1000.
Fairless Superintendent: Thank you for the cleaning of the South Water Tower.
VILLAGE ADMINISTRATOR: Steve Hartman-absent
Water:
Provided council with the Hazen & Sawyer Engineering’s Muskingum Avenue Water Pressure Evaluation Report:
Nutshell: Finds that the Village is delivering the required water pressure to the area water mains, that the individual homeowners may want to investigate possible issues within their home water systems, and that Hazen & Sawyer does not recommend any modifications to the Village distribution system.
Department will be tying in the waterline on 7th street this week.
Streets:
Department will be working on the 7th St waterline.
Sewer:
Department is looking to replace the cab and chassis of the 2003 truck.
Electric:
Still waiting to hear from First Energy concerning the purchase of the 69kV line between Harmon and Warmington Road.
An ad for the 4th lineman has been posted on Monster.com and have received one application to date.
Hillview extension is progressing.
The small bucket truck will need replaced as it will no longer be certified as of 2015. Council Member Hilliard asked Lineman Swan about the truck being out of service. Swan stated the bucket will be considered unsafe. The new truck quote is for $ 168,285 and takes about a year to have built. The quote is for 30 days. The State Purchasing price will go up 3% effective November 1st.
Village:
Tree removals from last meeting will take place this week.
VA has been working on setting up meetings for cleaning out the run behind the Heitgers. VA Hartman had reported he has calls into Beaver and Malavite.
VA checked out the waterway next to Council Member Strausbaugh's house. There wasn't anything green in it. There had been rain and it must have washed it down.
Council Member Godwin: Discussed the moving of the tree as discussed at the last meeting. He also discussed sink holes at 417 W. Main and McKinley where two trees had been removed years ago.
Council Member Strausbaugh requested that the VA be asked why the tower level fluctuates. Mayor Schwab stated it was the draw from Shearer's.
Council Member Hilliard asked if the towers were set up for the automatic feed set-up. Clerk King stated that they have only been paid 50% of the project. Mayor Schwab stated they are still working on it. Council Member Godwin stated if pressure gets too high the main will break. Council Member Strausbaugh stated the minimum is not good enough for him, that you want better than the minimum. Mayor Schwab replied that physics states that with the height of our tower, 43psi is the maximum.
Council Member Hilliard asked if the VA had the electric gate quote. He thinks it would be a wise purchase. He also stated there was another gate that needed fixed.

VA Search: 29 applicant resumes received & are being reviewed by Search Committee. The Mayor provided a copy of current VA Salary & Benefits. Acknowledgment letters have been sent to all applicants. The Search Committee will meet with EDDS on October 24th at 6:30 for their input.
Draft of an electric agreement with Hillview that defines the obligations of the Village and the Hillview Court owner is complete & being reviewed by the Solicitor.
Zoning Board of Appeals Meeting is scheduled for October 24th at 7 pm to review a Variance requested by Brewster Dairy for installation of storage silos adjacent to manufacturing facility on Harriman Street.

Remind Council to look over and sign the check register on the table.
Flu shots are November 14, 2013 from 10:30 to 11:30 in Village Hall. Please bring youR insurance cards.
The fire pay is $ 4,527.98 for September runs.
Food drive report: Only two donations have been made. Council Member Godwin stated that donations for the Food Cupboard are down and the $ 1,000 donation would be really helpful.
COMMITTEE OR COUNCIL REPORTS: : *NOTE: The Goal of any committee meeting is to discuss an issue or proposal and to provide, by a consensus of the committee members, ONE recommendation to Council.
Council Member Tharp: Employee Committee met tonight to discuss handbook changes and on-call pay.
Economic Development Committee met on 10/07.
VA Search Committee minutes from 10/15; Committee reviewed the 29 resume submittals; reviewed & recommends that the drafts of a VA Duties & Salary ordinance & an Income Tax Administrator ordinance be adopted by Council; Mayor provided council a copy of minutes and the two proposed ordinance drafts for review.
Income Tax Issue 5 on November Ballot info sheet in November Utility Bills is not permitted by ORC per the Solicitor McCallin.

COUNCIL MEMBER BICHSEL MOVED, SECONDED BY COUNCIL MEMBER THARP and motion carried to draw up an ordinance to vacate the utility easement between Lots 1493, 1494, & 1495. The vote: All yes.
COUNCIL MEMBER GODWIN MOVED, SECONDED BY COUNCIL MEMBER BICHSEL and motion carried to donate $ 1,000 to the Fairless Food Cupboard. The vote: All yes.
COUNCIL MEMBER HILLIARD MOVED, SECONDED BY COUNCIL MEMBER GODWIN and motion carried to purchase magnets with Village phone numbers at a cost of $460. The vote: All yes.
COUNCIL MEMBER THARP MOVED , SECONDED BY COUNCIL MEMBER GODWIN and motion carried to draw up an ordinance to approve the purchase of a new bucket truck for the Electric Department at a cost of $ 168,285 through the State Coop Purchasing Program. The vote: All yes.
COUNCIL MEMBER THARP MOVED, SECONDED BY COUNCIL MEMBER HILLIARD and motion carried to draw up an ordinance renewing Prosecutor Larry Chapanar's contract for one year at a cost of $ 11,500. It was stated that he has been more involved than he has been in the past. The vote: All yes.
COUNCIL MEMBER HILLIARD MOVED, SECONDED BY COUNCIL MEMBER BICHSEL and motion carried to purchase turkeys and hams for the employees for the holidays. The vote: All yes.
COUNCIL MEMBER THARP MOVED, SECONDED BY COUNCIL MEMBER STRAUSBAUGH and motion carried to draw up an ordinance making changes to the employee handbook. The vote: All yes.
COUNCIL MEMBER THARP MOVED to adjourn the meeting at 8:43pm.
